I help clients buy, sell, and develop property. I have extensive experience handling the complexities associated with contaminated property, including pursuing and defending cost recovery actions, negotiating cleanup orders with federal, state, and local agencies, conducting adequate due diligence, and crafting site-specific characterization and cleanup plans. I also counsel clients on the risk of buying and selling contaminated property and assist them in drafting contractual language to protect against such risks. When not working on contaminated sites, I help clients obtain land use approval for their development projects including Corp permits, NPDES permit hydraulic project approvals, shoreline permits, SEPA determinations, conditional use permit variances, and building permits.

Professional Highlights:

Selected as regional counsel for a national development company to advise on envrionmental matters associated with acquisition and development of multiple properies.

Represented a Fortune 300 Company in complex negotiations for the sale of contaminated industrial property.

Advised private school on actions necessary to repond to contamination discovered during construction of new building on campus and to preserve right of recovery against responsible parties.

Represented client throughout all aspects of retail development project, from purchase and sale negotiations, financing and title issues, to tenant leases, easement agreements and contractor issues.

Counseled lender on risks of lending funds for development of condominium project on contaminated property and helped lender draft appropriate loan conditions to mitigate those risks.

Assisted quasi-public agency obtain all land use permits necessary for repair and upgrade of over-water facility, including shoreline substantial development permit, hydraulic project approval, and Section 10 and Section 404 permits.

Represented major railroad corporation in negotiations with Environmental Protection Agency and other potentially responsible parties concerning historic contamination in waterway sediments.

Negotiated settlement with major oil company and local oil distributor for recovery of remedial action costs incurred to clean up former bulk plant site.

Selected as a "Rising Star" by Washington Law & Politics magazine, each year 2000-2004 and selected as a "Super Lawyer" in 2004.

Admitted to practice before the Washington State Supreme Court, the United States District Court for the Western and Eastern Districts of Washington, and the United States Court of Appeals for the Ninth Circuit.
