Kevin K. Bell

Mr. Bell attended Furman University, receiving his B.S. Degree in Mathematics in 1987.  He received his J.D. in 1992 from the University of South Carolina School of Law where he was a member of the Order of Wig and Robe.  His practice is complex litigation and appeals, with areas of emphasis in insurance.

Mr. Bell's litigation practice has involved a wide array trial and appellate matters for the firm's clients, including collapsed bridges, construction defects, product defects, computer software design failures, unfair competition, Sec. 1983 claims against correctional officers, wrongful termination, copyright infringement, defamation, employment discrimination, medical malpractice, and unfair trade practices.  In recent years, the majority of Mr. Bell's litigation practice has involved class action defense.

Mr. Bell's insurance practice centers around two distinct areas of concentration, life insurance and commercial liability insurance.  Mr. Bell's work with the life insurance industry is an extension of his experience in the legal department of a life insurer, and it has involved representation of life insurers in virtually every aspect of the business: claims, servicing, market conduct, bad faith, fraud, accidental death, suicide, rescission, unfair discrimination, regulatory examinations, compliance, unfair competition, defamation, trade secrets, commission disputes, failure of interest sensitive products, agent misconduct, licensing, and disciplinary proceedings.  The insurance products involved have ranged from home service policies to complex interest sensitive policies.  The legal work has involved preventive advice, training, individual litigation, and class actions.  In addition to direct handling of matters in South Carolina, Mr. Bell also works with insurers to oversee litigation in other jurisdictions.

Mr. Bell's second area of insurance concentration involves commercial liability insurance claims pursuant to both general liability policies and various professional errors and omissions policies.  Although not limited by design, the firm's clients in these matters tend to be corporate policyholders in the construction industry and the insurance industry.  The firm has successfully pursued insurance coverage litigation for a variety of underlying claims, including construction defects, wrongful death, project delays, negligent supervision, agent misconduct, failure to advise, false imprisonment, and improper third party administration.  Mr. Bell is also retained by liability insurance carriers to offer coverage opinions under various forms of individual and commercial liability insurance.
