Tom Magan has practiced labor and employment law since 1970. He has counseled companies on union avoidance and represented them in NLRB representation cases arising out of union organizing campaigns. Magan has served on hundreds of negotiating teams for collective bargaining and frequently been the chairman of such teams. He has represented management in hundreds of arbitration cases. In addition, he regularly counsels management on compliance with various state and federal civil rights laws including the Civil Rights Act of 1964, the Age Discrimination Employment Act, the Americans with Disabilities Act and the Family and Medical Leave Act. He has defended companies in lawsuits alleging violations of state and federal laws. He has also represented two universities in employment and other matters including the dismissal of a tenured professor and has also defended companies in employment contract cases and has prosecuted and defended covent-not-to-compete, trade secret cases. Magan has argued cases before the United States Court of Appeals for the Sixth and Seventh Circuits and the Indiana Supreme Court. Thomas O. Magan has practiced labor and employment law for over thirty-four years. He is particularly experienced in the following subspecialties: 1. Collective bargaining, including first contracts; 2. Decertification proceedings under the National Labor Relations Act; 3. Advising management in union organizing campaigns; 4. Representation cases under the National Labor Relations Act; 5. Unfair labor practice trials; 6. Labor law issues involved with plant closures, relocations, and mergers and acquisitions; 7. Arbitration of policy issues arising under a labor contract; 8. Arbitration of discharge cases; 9. Litigation of cases arising under Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, the Age Discrimination in Employment Act, and the Family and Medical Leave Act; 10. Prosecution and defense of covenant-not-to-compete cases; and 11. Development of employment policies and procedures, including rules of conduct.
