Markus Fellner specializes in Austrian and EC-Competition/Antitrust Law and Distribution Law. He has registered mergers according to Austrian as well as European Competition Law in areas like consulting, electronic wholesale, IT services, mobile transmission devices, heating and air conditioning systems and ultra sound equipment. He has also counseled and represented businesses like resort hotels and producers of communication equipment, computer tomographs, and gypsum and plaster products in cartel and abuse of dominant position proceedings before Austrian and European competition authorities. His distribution law practice includes drafting and consulting on exclusive distribution systems, exclusive purchasing agreements, selective distribution agreements, franchising and commercial agency agreements in such diverse fields as electric household equipment, beverages, clothing and cosmetic goods. He has also represented telecommunication companies in regulatory matters. Markus Fellner's other European Law practice includes matters relating to state aid, the internal market (freedom of establishment and to provide services), EC company law, telecommunications and energy law. A large part of Markus Fellner's practice is taken up by business and commercial law, in particular M&A transactions, business organizations and joint ventures. He has founded and consulted many businesses and has orchestrated M&A transactions from start to finish, including LOl, due diligence, drafting and negotiation of contracts and of course consulting on the competition law aspects. He is particularly experienced in transactions in the telecommunication and New Economy businesses. Mr. Fellner is also an expert on general contracts law and in particular leasing contracts. Another part of Mr. Fellner's practice is alternative dispute resolution, in particular international arbitration. He has represented the largest construction company in Europe in an ICC Arbitration proceeding and one of the leading multinational concerns in a Vienna Rules proceeding and his cases include matters involving international construction contracts, partnership agreements and acquisitions.
