John L. Cooper joined the firm in 1973 and has maintained a diverse trial practice in intellectual property, antitrust and business litigation.  He has particularly expertise in technology-related litigation and is the senior member of the firm?s Intellectual Property and Technology Group.

 

Mr. Cooper regularly represents technology companies in patent and other intellectual property litigation as well as in antitrust and technological defect litigation and disputes. He serves as primary outside counsel on litigation and business matters to Dolby Laboratories and other technology companies. He counsels multimedia and technology clients on intellectual property, antitrust and commercial issues relating to technology and the internet. He has represented international manufacturers of telecommunication satellites relating to technical malfunctions.

 

Mr. Cooper?s litigation practice includes representation of Dolby Laboratories, Inc. defending and prosecuting major and protracted patent litigation. He has represented the UK-based Bass PLC and Holiday Inns in litigation arising out of Bass PLC?s $2.3 billion acquisition of Holiday Inns in 1990 as well as in litigation related to Bass PLC?s acquisition of Inter-Continental Hotels. Mr. Cooper was co-lead counsel in a suit against three of the nation?s largest plywood manufacturers, and obtained an antitrust judgment for approximately $2 billion.   On appeal, he won the argument against the former Solicitor General Robert Bork.   Mr. Cooper also served as defense liaison counsel in the Technical Equities litigation, considered to be one of the largest business/securities fraud cases in California history.  He was successful in severing his client (the law firm which represented Technical Equities) from the litigation and negotiated a settlement on their behalf shortly after trial began.  Mr. Cooper headed the trial team defending the Wm. E. Pollock Company, one of seven securities dealers sued in a $70 million action brought by the City of San Jose.  A successful settlement was reached during the fourth month of trial.  He has defended numerous other large securities and antitrust actions in both federal and state courts.

 

Mr. Cooper has made numerous lectures and presentations to various bodies, including the American Bar Association, the Ninth Circuit Judicial Conference and the Intellectual Property Commissioners for the European Economic Community. His paper, ?Balancing of Competitor Cooperation and Competition for Consumer Welfare and Viable International Competition? was published in the Antitrust Law Journal.
