My practice is concentrated on antitrust, competition, Robinson-Patman, Hart-Scott-Rodino, and consumer protection issues, with newspapers, book publishers, music publishers, broadcast media, trucking companies, a humane society, and a major medical center as my primary clients. I have represented clients from Hawaii and Alaska to Maine and Florida, often appearing on their behalf before the Antitrust Division of the U. S. Department of Justice, the Federal Trade Commission, and state antitrust agencies in investigations of mergers, acquisitions, pricing, joint ventures, and distribution practices. My newspaper experience includes representation of the Honolulu Star-Bulletin as lead attorney in litigation resulting from the proposed termination of the Honolulu newspaper Joint Operating Arrangement (JOA); representation of The Denver Post as lead attorney in an application approved by the Attorney General for a JOA between the Denver newspapers; representation of the Denver Newspaper Agency, MediaNews Group, Inc., and The Denver Post as lead attorney in litigation brought by advertisers challenging the JOA; representation of the owners of the Chattanooga Times in the termination of the Chattanooga JOA; representation of the owners of the Nashville Banner in termination of the Nashville JOA; representation of the owner of the Tulsa World in termination of the Tulsa JOA; representation of the owner of the York Dispatch as lead attorney in an application approved by the Attorney General for a JOA between the York, Pennsylvania, newspapers; and representation of the York Newspaper Company as lead attorney in litigation brought by a citizen challenging the JOA. I also represent newspapers in disputes involving circulation and auditing problems, primarily before the Audit Bureau of Circulations.While at the Antitrust Division of the U. S. Department of Justice, I worked extensively on investigations and cases in the newspaper, magazine, book publishing, motion picture, electric lighting, toy, cigar, animal feed, sugar, and aluminum industries, among others. I also served as Special Litigation Counsel to the Assistant Attorney General, Special Assistant U. S. Attorney in the District of Columbia and many other jurisdictions, and liaison to the Capper-Volstead Study Committee of the U. S. Department of Agriculture.I hold a B. A. in Economics from Washington & Lee University, a Masters in Economics from Columbia University, and a J. D. from Columbia University Law School. Since 1987, I have taught antitrust law at Vanderbilt University School of Law, currently as Adjunct Professor of Law. For many years I served as Chair of the Antitrust and Business Regulation Section of the Tennessee Bar Association.
