I am a co-author of the book California Pretrial Practice & Forms (James Publishing Company, 2004) (see www.jamespublishing.com). This is a two-volume desk set emphasizing practical advice and skills. The publisher describes the book as a "landmark new work" that "probes every step of civil procedure before trial." It "delivers good and reliable answers with its outline format, tight writing, superb scholarship, and extensive citations."||I have substantial experience with both federal and state antitrust laws and have handled numerous cases relating to California's unfair competition law. (Ca. Bus. & Prof. Code section 17200) as well as the California Unfair Practices Act (Ca. Bus. & Prof. Code section 17000, et seq.), especially the below cost sales statute. My advisor at Harvard Law School was the antitrust guru Philip Areeda and his teaching continues to exert a major influence on my practice. Among the numerous unfair competition matters I have handled are many cases involving competition by former employees which often implicate both California's special statute restricting the ability to enforce convenants not to compete (Ca. Bus. & Prof. Code section 16600, et seq.) and California's version of the Uniform Trade Secret Act (Ca. Civ. Code section 3426). I also have substantial experience with California's "litigation privilege" (Civ. Code section 47).

I have handled numerous cases involving distribution and competition in the golf industry (representing equipment manufacturers and retailers) and in the solid waste collection business (especially the issue of exclusive franchises). I have had several fraudulent conveyance cases especially arising out of the settlement of other litigation. (For example, I have represented attorneys accused of settling investor's claims "too cheaply" by a successor trustee as well as claims that a settlement of an antitrust case was part of a scheme to defraud other creditors.) I have been involved in securities fraud cases (I was involved in the first reported decision on a discovery dispute under the Private Securities Litigation Reform Act of 1995), intellectual property cases and class actions. I most enjoy working with sophisticated legal issues and believe my legal analysis and briefing skills are equal to those of virtually any practitioner.
